These Terms of Use (the “Terms”) govern your access to and use of the website located at https://militaryretirementplanningacademy.com (the “Site”), which is owned and operated by MaxWealth, LLC, doing business as Military Retirement Planning Academy (“MaxWealth,” “Military Retirement Planning Academy,” “we,” “us,” or “our”). By accessing or using the Site in any manner, you acknowledge that you have read, understand, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site.

For purposes of these Terms, all references to “MaxWealth” shall be deemed to include MaxWealth, LLC and its d/b/a Military Retirement Planning Academy, and any reference to “the Site” includes any successor or related websites owned and operated by MaxWealth, unless otherwise expressly stated.

1. Nature of the Site and Services

The Site is provided by MaxWealth, LLC for the primary purpose of offering general educational information regarding financial concepts, insurance, retirement, and related topics, and to describe certain group and individual coaching services that may be offered by MaxWealth, LLC.

Although Trevor Maxwell (the “Principal”) is licensed as a life insurance and annuities agent in multiple states, and is an Investment Advisor Representative holding a Series 65 license through Cape Investment Advisory, Inc., the Site itself does not effect transactions in insurance policies, securities, or other financial products, nor does it constitute an offer to sell or a solicitation to buy any such products.

Any insurance, investment advisory, or other professional relationship between you and MaxWealth,LLC, the Principal, or any affiliated entity will be established, if at all, only pursuant to separate written agreements executed by the parties and only where MaxWealth, LLC and its personnel are appropriately licensed, registered, or exempt.

2. No Advice; No Client or Advisory Relationship

All content made available on or through the Site—including, without limitation, articles, posts, videos, webinars, tools, templates, downloads, emails, and other materials (collectively, the “Content”)—is provided solely for general informational and educational purposes.

The Content is not intended to, and does not, constitute financial, investment, insurance, legal, tax, or other professional advice, and should not be relied upon as a substitute for individualized advice from a qualified professional who is familiar with your specific circumstances.

Your use of the Site, your review or download of any Content, or your submission of information through the Site (including any request for a consultation or participation in Coaching, as defined below) does not create an insurance client relationship, an investment advisory relationship, a fiduciary relationship, or any other professional engagement between you and MaxWealth, LLC or the Principal.

Any such relationship will arise only if and when you enter into one or more written agreements with MaxWealth, LLC or its affiliates, and then only on the terms and conditions set forth in those agreements.

You should not take or refrain from taking any action based on the Content without first consulting with your own financial, insurance, tax, or legal advisor.

3. Coaching and Educational Programs

From time to time, the Site may describe or provide access to group coaching, individual coaching, courses, workshops, membership programs, or similar offerings (collectively, “Coaching”).

Coaching is intended to provide education, structure, and support regarding financial behaviors, decision-making frameworks, and related life planning topics.

Coaching is distinct from, and is not a substitute for, personalized financial planning, investment advisory services, insurance brokerage services, or legal or tax advice.

Unless expressly stated in a separate written agreement, Coaching does not include the recommendation, selection, or active management of specific securities or investment products, the placement of insurance coverage on your behalf, or any ongoing monitoring or fiduciary oversight of your accounts or policies.

Any examples, illustrations, or case studies referenced in connection with Coaching are for demonstrative purposes only and may not be appropriate for your individual situation.

4. No Warranties; No Guarantee of Results

The Site and all Content are provided on an “as is” and “as available” basis, without any representations or warranties of any kind, whether express, implied, or statutory, including, without limitation, implied warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, and course of dealing or performance.

MaxWealth does not warrant that the Site or any Content will be error-free, current, complete, reliable, uninterrupted, secure, or free of viruses or other harmful components.

MaxWealth does not make any representation, warranty, or guarantee regarding the results that may be obtained from the use of the Site, the Content, or any Coaching, and you understand and agree that any decisions you make and any outcomes you experience are solely your responsibility.

5. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall MaxWealth, its owners, members, managers, officers, directors, employees, contractors, agents, or affiliates be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including, without limitation, loss of profits, loss of data, business interruption, or other economic loss, arising out of or in connection with:

-Your access to or use of the Site or Content;

-Your reliance on any information provided on or through the Site or in connection with Coaching; or

-Any inability to access or use the Site, regardless of the cause.

This limitation of liability applies whether the claim is based in contract, tort (including negligence), strict liability, statute, or any other legal theory, even if MaxWealth has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full. In such jurisdictions, MaxWealth’s liability shall be limited to the maximum extent permitted by law.

6. Licensing, Registration, and Jurisdictional Limitations

Any references on the Site to insurance, annuities, investment advisory services, or other regulated activities are intended solely for individuals located in jurisdictions where the Principal and/or MaxWealth, LLC, or their affiliated entities, are properly licensed, registered, or exempt from registration.

Nothing contained on the Site shall be construed as an offer to sell or a solicitation to buy any insurance product, security, or advisory service in any jurisdiction in which such offer or solicitation would be unlawful or in which MaxWealth or its personnel are not appropriately licensed or registered.

If you have any questions regarding whether we may lawfully provide services to you, you should contact us directly prior to relying on any information contained on the Site.

7. Intellectual Property

All right, title, and interest in and to the Site and the Content, including, without limitation, all text, graphics, logos, trademarks, service marks, trade names, images, audio, and video, and the selection and arrangement thereof, are owned by MaxWealth, LLC or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Site and to download and print a single copy of Content for your personal, non-commercial use only, provided that you do not remove or alter any copyright, trademark, or other proprietary notices.

Except as expressly permitted herein, you may not copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, or otherwise exploit the Site or any Content, in whole or in part, without MaxWealth, LLC's prior written consent.

8. Acceptable Use and Prohibited Conduct

You agree that you will use the Site only for lawful purposes and in accordance with these Terms. Without limiting the foregoing, you agree that you will not:

-Use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party’s use of the Site;

-Attempt to gain unauthorized access to any portion or feature of the Site, to other users’ accounts or information, or to any systems or networks connected to the Site, whether through hacking, password mining, or any other means; or

-Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission.

MaxWealth, LLC reserves all rights to monitor, restrict, or terminate your access to the Site in its sole discretion for any violation of these Terms or for any other reason permitted by law.

9. Information You Provide; Privacy

If you choose to submit your name, email address, or other personal information through the Site—for example, to request information, subscribe to communications, download materials, or schedule a consultation—you represent and warrant that all information you provide is accurate and complete to the best of your knowledge.

By submitting such information, you authorize MaxWealth, LLC to use it to respond to your inquiries, provide you with requested materials, send you educational or marketing communications, and otherwise operate and improve the Site and our services, all in accordance with our Privacy Policy.

The Site may utilize cookies, Google Analytics, and similar technologies to collect certain technical and usage information for analytics and performance purposes. 10. Third-Party Websites and Resources

The Site may contain links or references to third-party websites, content, services, or resources that are not owned or controlled by MaxWealth, LLC. These links are provided solely as a convenience and do not constitute an endorsement, sponsorship, or recommendation by MaxWealth, LLC of any third party or its products or services.

MaxWealth, LLC has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. Your use of any third-party websites or resources is entirely at your own risk and is subject to the terms and conditions and privacy policies of such third parties.

11. Geographic Scope

The Site is intended for use by individuals located within the United States of America. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with all local laws and regulations that may apply.

MaxWealth, LLC makes no representation that the Site or the Content is appropriate or available for use in locations outside the United States.

12. Modifications to the Site and Terms

MaxWealth reserves the right, in its sole discretion and at any time, to modify, suspend, or discontinue the Site (or any portion thereof) and to update or revise these Terms.

Any changes to these Terms will be effective upon posting the revised Terms on the Site, with the “Last Updated” date revised accordingly. Your continued use of the Site following the posting of any changes constitutes your acceptance of such changes.

13. Governing Law; Dispute Resolution

These Terms, and any dispute, claim, or controversy arising out of or relating to these Terms or your access to or use of the Site, shall be governed by and construed in accordance with the laws of the State of Virginia, without regard to its conflict-of-laws principles.

Subject to any applicable arbitration agreement you may enter into with MaxWealth, any legal suit, action, or proceeding arising out of or relating to these Terms or the Site shall be instituted exclusively in the state or federal courts located in Suffolk, Virginia, and you hereby consent to the exclusive jurisdiction and venue of such courts.

At MaxWealth, LLC’s election and where permitted by law, disputes may instead be resolved by binding arbitration before a mutually agreed arbitration provider, in which case the arbitrator’s decision shall be final and may be entered as a judgment in any court of competent jurisdiction.
